2. Collection and processing of personal data
a) Intended use
Our test vehicles record environmental data using various sensors and video cameras in the vehicle in order to develop driver assistance and driver information systems with automated driving functions for active and passive safety and comfort features. This data is primarily recorded on public roads. The environmental data recorded is then stored in a secure database and used for the development and validation of driver assistance and driver information systems along with automated driving functions and comfort features. These systems are designed to improve comfort and safety on the road and to safeguard the functionality of the vehicle through the recorded video data. The processing of the existing traffic infrastructure and the recognition of road users including their direction of movement are required to derive the correct vehicle response.
MAN Truck & Bus SE does not identify individual persons in the data records at any time.
b) Legal basis/bases for the processing of data by MAN Truck & Bus SE
The collection, processing and use of your personal data is based on a balancing of interests in accordance with Art. 6 (1) (f) GDPR. MAN Truck & Bus SE has a legitimate interest in processing your data for the (further) development of driver assistance and driver information systems along with automated driving functions and comfort features. The aim is also to implement quality assurance measures (necessary testing for validation), improve product, vehicle and road safety and thus reduce road accidents.
c) The processed data can be classified into the following data categories:
Videos/images of:
- Road users (vehicles and people),
- Vehicle number plates and lettering on vehicles,
- Lettering on shops and street signs,
- Other information in the immediate vicinity of the test vehicles that is captured by sensors.
3. Transfer of personal data
Within MAN Truck & Bus SE, your data is sent to those departments that require it as part of their work (e.g. Product Development in Technical Development).
MAN Truck & Bus SE works with service providers on the (further) development of driver assistance and driver information systems along with automated driving functions and comfort features. These service providers receive the data in compliance with the applicable data protection law on the basis of corresponding agreements for commissioned processing within the meaning of Art. 28 GDPR:
- Development service providers,
- Suppliers of safety-related driver assistance system components,
- Hosting service providers,
- IT service providers.
MAN Truck & Bus SE works with cooperation partners on the (further) development of driver assistance and driver information systems along with automated driving functions and comfort features. These companies are each involved in product development and the evaluation of trials and receive the data as data controllers under data protection law:

– Development partners, and
– Universities

If recipients are located in a country outside the European Union or the European Economic Area (‘third country’), the data may be transferred to a country where there may not be an adequate level of data protection, i.e. not comparable to that in the EU.
Please note that not all third countries have a level of data protection recognised as adequate by the European Commission. For data transfers to third countries where there is not an adequate level of data protection, MAN Truck & Bus SE has taken appropriate measures to protect your personal data, such as concluding what are known as standard data protection clauses.
4. Data storage and erasure
Data is only stored for as long as necessary for testing and trial purposes as well as quality assurance measures, including long-term observations, and development purposes. Further development of the systems also includes possible quality improvement and fault rectification after market launch. MAN Truck & Bus SE is legally obliged to carry out this fault rectification in certain cases for product liability reasons.
5. Your rights
You have the right to be informed about the data that relates to you, and the right to rectify your data. Provided that there are no statutory regulations to the contrary, you also have the right to erase your data and to object to the processing of your data, and the right to restrict the processing of your data. Furthermore, you have the right to data portability.
If we collect and process your personal data on the basis of your consent, you also have the right to revoke the consent you granted with immediate effect. The legality of the data processing carried out with your consent until you withdraw it remains unaffected by your withdrawal of consent. If necessary, we need to verify your identity before we can process your requests.
If, in spite of our efforts to maintain accurate and up-to-date data, incorrect information has been saved, we will correct such information upon corresponding request. In the event of complaints, users may also contact a data protection supervisory authority.
6. Security
MAN uses technical and organisational security measures to protect your data against accidental or premeditated manipulation, loss and destruction, and access by unauthorised persons.
Our security measures, such as data encryption, are regularly improved in accordance with technological development.
